Florida District Court of Appeals Upholds $2.25M Verdict

After receiving a $2,25 million jury award in the medical malpractice case involving the wrongful death of David Gabrielli, an 81 year old loving husband of our client, Marie, the Defendant’s Douglas Turnbull, M.D. and Diagnostic Clinic Medical Group, P.A. appealed the verdict. Now after two years, the Second District Court of Appeal’s has upheld the verdict on appeal.

Mr. Gabrielli had a known intolerance to Morphine, which was unfortunately ignored by his health care providers. Mr. Gabrielli was prescribed and given Morphine following a procedure for a ureter stone at Largo Medical Center, where he subsequently developed encephalopathy and died weeks later on Christmas morning.

Mr. Gabrielli was survived by his dear widow, Marie. The two were married for 54 years.

The Defendant’s never made a single settlement offer prior to the verdict, pushing Mr. Florin and Mr. Czelusta to seek justice from a jury in Pinellas County.
