According to Florida statutes, if a dog bites a person where the victim is lawfully present, the owner of the dog may be liable for any damages. There are two exceptions to this rule, though. First, if it is determined that the dog was provoked by the victim, the victim’s own negligence will be taken into account when determining damages, and the amount of compensation will be reduced accordingly. Second, if the bite occurs on the dog owner’s property and there is an easily visible sign providing warning of a dog, the owner may not be held liable for damages (unless the victim is under 6 years of age).
