Wil Florin and Thomas Roebig, Jr. recently recovered $230,000 from a combination of a negligent drivers Bodily Injury coverage and available Underinsured Motorist coverage, as well as another $850,000 from a property owner in an obstructed exit case for a roller bladder that suffered a serious injury.
The accident occurred as a result of an obstruction on a business property that obscured any exiting driver’s vision, as well as failure of the business to warn drivers with a stop sign or stop bar line. This obstruction and lack of warning caused a driver to exit the property without a line of sight of the public crosswalk immediately past the obstruction. As a result of failing to warn any exiting drivers of this hazard, a driver exited the business directly in the path of a roller blader who was skating on a public sidewalk. There was no time for the roller blader to take any evasive maneuvers to avoid the collision. The accident caused the roller blader’s leg to fracture after being run over by the vehicle. He was taken to a local hospital and ultimately suffered an above the knee amputation.
This is a case that points out why it is important for business owners to keeping their exits free and clear of any visual obstructions to drivers, as well as properly warning drivers of pedestrian traffic.
